The investigation by the tax department failed, and the police intervened

According to sources, the case of Fan Bingbing originated from a report by well-known TV host Cui Yongyuan on his network at the end of May 2018.

At that time, Cui Yongyuan posted several photos of his acting contract on his Sina Weibo. The contract included Fan Bingbing's name, and the contract stipulated that the remuneration was 10 million yuan after tax.Later, Cui Yongyuan also said that some entertainers adopted large and small contracts (yin and yang contracts), and separately agreed on a remuneration of 50 million yuan. The two contracts took a total of 60 million yuan in remuneration, and they only performed on the set for 4 days.This act is suspected of serious tax evasion.

Industry and commerce materials show that Fan Bingbing is the legal representative, shareholder, or executive of the company. There are at least 12-13 companies in mainland China, which are registered in Beijing, Wuxi, Jiangsu, and Horgos, Xinjiang.

At the end of June and early July, the police began to intervene in Fan Bingbing's "yin and yang contract" case, the above-mentioned insider told the Economic Observer reporter.

According to the source, the Beijing police first took away the professional from the listed company by way of a summons.

There are two types of summons: criminal summons and public security summons.According to the Criminal Procedure Law, a criminal summons means that a criminal suspect who does not need to be arrested or detained can be summoned to a designated place or his residence or unit for interrogation.The time limit for a criminal summons is 12 hours, which can be extended to a maximum of 24 hours.The Public Security Management Punishment Law does not define a public security summons. It only stipulates a time limit of 8 hours, which can be extended to 24 hours at the longest.

Which listed company does the person belong to?According to several sources, this is Huayi Brothers Co., Ltd. (hereinafter referred to as Huayi Brothers), which has worked closely with Fan Bingbing for many years.

On July 27, a reporter from the Economic Observer contacted Huayi Brothers’ office of the secretary of the board of directors for confirmation through telephone messages, email interviews, etc., but as of press time, there has been no reply.

The person involved in the case was detained by the supervisor, and the Fan brothers and sisters were prohibited from leaving the country

Informed sources: On July 2, 2018, the family members of this listed company person received a detention warrant issued by the Jiangsu police in Beijing, and learned that he had been detained on suspicion of concealing and deliberately destroying accounting documents.He was transferred to the detention center in Changzhou, Jiangsu.

The criminal law stipulates that the crime of concealing and deliberately destroying accounting vouchers, accounting books, and financial accounting reports refers to intentionally concealing and deliberately destroying accounting vouchers, account books, and financial reports that are subject to statutory preservation obligations, and the circumstances are serious.

The sentencing standard for this is: if the circumstances are serious, a fixed-term imprisonment of not more than five years or criminal detention shall be imposed, and a fine of not less than 20,000 yuan but not more than 200,000 yuan shall be imposed concurrently or separately.

On July 3 and 4, the family members of the above-mentioned person involved in the case and the lawyers they entrusted came to Changzhou and Nanjing, Jiangsu, and were told that the compulsory measures of the person had been changed to residential surveillance in a designated place.At the same time, the police said that they did not agree to arrange a meeting with a lawyer for the time being.

On July 27, a reporter from the Economic Observer called the office phone number of the spokesperson of the Jiangsu Provincial Public Security Department several times, but no one answered.

People familiar with the matter also introduced that, apart from the professionals of the above-mentioned listed companies, several staff members around Fan Bingbing were also investigated by the police and taken compulsory measures.One of them is a foreigner who has worked with Fan Bingbing for at least ten years. He has not only been her manager, but also served as the legal representative of a company under Fan Bingbing.

Some sources also said that Fan Bingbing's foreign agent was taken away for investigation. This has been circulating in the entertainment industry for some time.

On July 27 and 28, a reporter from the Economic Observer called the foreigner's mobile phone several times, but the calls were all in a state of forwarding.

As for Fan Bingbing herself, a source said that she is currently in Beijing and has not yet been subjected to compulsory measures, but she and her younger brother Fan Chengcheng have been charged at the border and restricted from leaving the country.

Recently, there was a variety show that was going to be recorded outside of China, and Fan Chengcheng was invited.But at the end, it was found that he could no longer leave the country. After investigation, he and his sister Fan Bingbing were both under "border control".

In this regard, the Economic Observer reporter tried several times to contact Fan Bingbing and Zhang Xiaowei, Fan Bingbing's studio promotional media extension, for verification, but has not yet received a reply.

An official from an entry-exit management department told the reporter of the Economic Observer that it is a common practice to adopt border control measures and restrict exit for a period of time for the persons involved in the case and their close relatives.
