On June 29, the first-instance criminal judgment of Wang Moujia for accepting bribes published by China Judgment Documents Network disclosed the list of bribes of Wang Moujia, wife of Zhang Shiming, the former head of the land in Shenzhen.

Zhang Shiming was born in June 1952 in Shunping, Hebei Province. He has served as the head of several committees, offices and bureaus of the Shenzhen Municipal Government, the director of the Shenzhen Quality and Technical Supervision Bureau, the director of the Municipal Land Resources and Real Estate Administration, and the director of the Municipal Transportation Commission. In 2010, Zhang Shiming was transferred to the Secretary-General of the Standing Committee of the Shenzhen Municipal People's Congress, and resigned in 2014.In September 2016, there were media reports that Zhang Shiming was taken away by the Guangdong Provincial Commission for Discipline Inspection for investigation, and Zhang Shiming has since disappeared.

Not long ago, Zhang Shiming's name appeared in another criminal judgment published by China Judgment Documents Network, saying that Zhang Shiming had been dealt with in a separate case for accepting bribes. The judgment also showed that Zhang Shiming's case was related to Lu Ruifeng, the former executive deputy mayor of Shenzhen. Through Lu Ruifeng's introduction, Zhang Shiming met a boss and accepted benefits from the boss and made profits for him.

So how did Wang Moujia, the wife of Zhang Shiming, accept bribes? The verdict presented the testimony of Wang Mou, a shareholder of Jinliantai Investment Co., Ltd., Huang Mou, chairman of Shenzhen New World Group Co., Ltd., and others.

Wang confirmed that in order to thank Zhang Shiming for his help in the Banshan Yujing project, Jinliantai Company and Qiu, the chairman of Jinliantai Company, gave Zhang Shiming HKD 4 million and RMB 2.54 million in cash.Give to Zhang Shiming and Wang Moujia two shops.

Huang confirmed that in 2007, because Zhang Shiming gave preferential treatment and consideration in the land replacement pricing plan for the third phase of Liyuan Pavilion project, he gave Zhang Hong Kong dollars 2 million yuan;I helped out and gave Zhang Hong Kong dollars 500,000 yuan; in 2009, at a 40% discount on the market price, I sold three sets of real estate properties in the Four Seasons Landscape to Zhang Shiming and Wang Moujia, with a discount of 1.92 million yuan; from 2005 to 2009,Donated HK$300,000 to Zhang Shiming six times before and after the Spring Festival and Mid-Autumn Festival.

The court found Wang Moujia's two criminal facts.

First, from 2008 to 2014, knowing that Zhang Shiming used his position to provide assistance to Shenzhen Jinliantai Investment Co., Ltd., Wang Moujia and Zhang Shiming jointly accepted the company's chairman and general manager Qiu Mou for two times.and RMB 2.54 million given by shareholder Wang.

Second, in 2009, knowing that Zhang Shiming was using his position to help Shenzhen New World Group Co., Ltd., Wang Moujia and Zhang Shiming jointly received RMB 190.0825 from Huang Mou, the chairman of the company, in the form of buying a house at a low price.ten thousand yuan.In 2014, in order to cover up the crime, Wang Moujia made up the price difference of the house payment to Shenzhen New World Group Co., Ltd.

The verdict shows: Wang Mojia disregarded the laws of the country, and together with Zhang Shiming, a national employee, took advantage of Zhang Shiming's position to seek benefits for others, and jointly accepted other people's property. The amount was extremely huge. His behavior constituted the crime of accepting bribes and should be punished according to law.

In the end, the court sentenced Wang Moujia to three years in prison, suspended for five years, and fined 200,000 yuan for accepting bribes.

The verdict made the following four explanations for why Wang Moujia was sentenced to probation.

First, in the joint crime, Wang Moujia played a secondary and auxiliary role and was an accomplice. He should be given a lighter and mitigated punishment according to law.

Second, after Wang Moujia committed a crime, he voluntarily surrendered and confessed his crime truthfully.

Third, Wang Moujia returned all the stolen goods and could be given a lighter punishment as appropriate.

Fourth, Wang Moujia voluntarily pleaded guilty, showed remorse, was older, suffered from a serious illness, and was not in danger of committing another crime. The probation had no major adverse effects on the community where he lived.
